Understanding immigration procedures for employed persons in Tanzania

1. INTRODUCTION

This article applies to foreigners planning to enter Tanzania as employed persons under Work Permit Class C and Resident Pass Class B
First it is important to understand that in Tanzania work permit application process is separate from resident pass application process as follows;

  1. Work permit application and approval is under the Commissioner of Labour and there is a separate application process and fee.
  2. Resident pass application and approval is under the Director of Immigration Service and there is a separate application process and fee.

2. WHO QUALIFIES FOR WORK PERMIT CLASS C AND RESIDENT PASS CLASS B IN TANZANIA

Tanzania like any other country endeavors to protect local jobs and is unlikely to issue work permits for jobs that can be performed by locals. Sponsoring employers are expected to demonstrate that they cannot get suitable local candidates to fill the vacancy.

There is no minimum qualifications and experience for expatriates but they must demonstrate they have the required qualifications and experience to perform the job. Sponsoring employers are therefore required to attach both a job description for the position and CV of recommended expatriate.

Only holders of a valid work permit can apply for a resident pass in Tanzania.

3. THE MIGRATION PROCESS FOR HOLDERS OF CLASS D WORK PERMIT AND CLASS C RESIDENT PASS

Step 1: Application for Work Permit Application
The first step is for sponsoring employer to submit an application for work permit on dully completed Work Permit application form (TIF 1) in duplicate signed by both the sponsoring employer and expatriate employee.
The requirement is that a work permit application to the Commissioner of Labour in Tanzania should be submitted while the sponsored employee is outside the Country and the employee only enters the country after the permit is approved.
However where there is urgency for employee to start working, the expatriate can enter the country on a Business VISA which serves as a temporally work permit.
It should be noted that a Business VISA is valid for 3 months , can be renewed for a maximum of three times and expires either at the end of three months or if the employee travels out of the country.
The following documents should be attached to the work permit application form;

  1. Covering letter by sponsoring employer
  2. Curriculum vitae (CV) of the employee
  3. A copy of National Passport (with validity of not less than a year);
  4. Certified copies of Academic Certificates of employee
  5. Service testimonial from previous employers
  6. Three (3 passport size photographs
  7. Employment contract, duly signed by the employer or his representative
  8. Job description for the position to be filled by the foreign employeedw3232
  9. Certificate of Company Incorporation/Registration
  10. Company PIN certificate
  11. Company Tax clearance certificate
  12. Company memorandum and articles of association
  13. Business License
  14. General security covenant (TIF. 13)

The Commissioner of Labour takes a minimum of one month to process an application. There is no Cleary stated maximum period but can go up to three months.
There are three possible decisions of the Commissioner of Labour on submitted applications;

  1. Work Permit is approved
    The work permit is in the form of a certificate issued to the sponsoring employer who retains the original copy while the employee retains a certified copy.
  2. Work permit is deferred because of none compliance with a certain requirement which can be remedied or because an essential document has not been attached. The sponsoring employer will be required to submit the missing information or document.
  3. Work Permit application is rejected.

Step 2: Resident Pass Application
Where the work permit has been approved, the expatriate can proceed to apply for a Resident Pass by filling the application form otherwise called data sheet in duplicate (This form has no form number as of now). Where the expatriate will be accompanied by his family to Tanzania, dependant application form should be submitted with the resident pass application form
It should be noted that the person is required to apply for a Resident Pass while outside the country. Where the person opts to apply for the resident pass while within the Country, the person should obtain a special pass which acts as a temporally resident pass.
The following documents should be attached to the application form/data sheet;

  1. Covering letter from sponsoring employer
  2. Copy of Work Permit Issued by the Commissioner of Labour
  3. Curriculum vitae (CV) of the employee
  4. A copy of National Passport (with validity of not less than a year);
  5. Certified copies of Academic Certificates.
  6. Employment contract, duly signed by the employee
  7. Job description
  8. Six (6) passport size photographs of applicant and 3 photographs for each dependant
  9. Evidence of dependency for each dependant in form of marriage certificate or birth certificate.
  10. Certificate of Company Incorporation/Registration of sponsoring employer
  11. Company PIN certificate of sponsoring employer
  12. Company Tax clearance of sponsoring employer
  13. Company memorandum and articles of association of sponsoring employer
  14. Business License of sponsoring employer

The approved pass is in the form of a certificate in the name of the foreign employee and must be produced to any immigration officer on demand. An endorsement can also be made on the passport in which case the employee only need carry the passport.
The resident pass process takes an average of one month.

4. APPLICABLE GOVERNMENT FEES FOR MIGRATION SERVICES IN TANZANIA FOR NONE EAST AFRICANS

PERMIT/PASS FEES IN DOLLARS
1.     Business VISA : 250 per VISA/Entry
2.    None refundable work permit application fees 1,000
3.    Special pass fees 600
4.    Reside pass fees paid only on approval of pass 2,050
5.    Dependant pass fees per dependant 50
